Terms of Service
Please read these Terms carefully. They govern your access to and use of AppNative.io and all related services.

These Terms of Service ("Terms") form a binding legal agreement between you ("you", "your", or the "Customer") and AppNative.io, operated by Virtual Horizons ("AppNative.io", "we", "us", or "our"). By creating an account, accessing the dashboard, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1.The Service
AppNative.io is a software-as-a-service platform that converts existing web applications into native iOS and Android applications (the "Service"). The Service includes, without limitation: connecting source code repositories, configuring app metadata and branding, generating native project builds, code signing and provisioning, push notification infrastructure, in-app purchase configuration, app store listing management, analytics, team collaboration, white-label reseller capabilities, and an affiliate referral program.
We may add, modify, suspend, or discontinue any feature of the Service at any time. We will use commercially reasonable efforts to provide notice of material changes that adversely affect your use of the Service.
2.Eligibility & Accounts
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. You agree to provide accurate, current, and complete information and to keep it updated.
3.Subscriptions, Billing & Payments
Paid plans are billed on a recurring basis (monthly unless otherwise stated) through our third-party payment processor, Stripe, Inc. By subscribing, you authorize us and Stripe to charge your payment method for all applicable fees, including recurring charges, until you cancel. Prices are stated exclusive of taxes unless noted, and you are responsible for any applicable taxes.
Subscriptions renew automatically at the end of each billing period. You may cancel at any time from your account settings; cancellation takes effect at the end of the then-current billing period, and you will retain access until that time. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial billing periods, unused features, or downgrades.
If a payment fails, we may suspend or downgrade your access until payment is resolved. We reserve the right to change our pricing; we will provide reasonable advance notice of price changes affecting active subscriptions.
4.Free Trials & Free Plan
We may offer a free trial or a limited free plan. Free tiers may have reduced features, build limits, or usage caps. We reserve the right to determine your eligibility for, and to modify or terminate, any free trial or free plan at any time without liability, to the extent permitted by law.
5.Your Content & Source Code
You retain all ownership rights in the source code, repositories, assets, branding, and other materials you submit, connect, or upload to the Service ("Customer Content"). You grant us a limited, non-exclusive, worldwide license to access, host, process, build, compile, sign, and transmit your Customer Content solely as necessary to provide and improve the Service for you.
You represent and warrant that you have all rights necessary to grant this license and that your Customer Content and its use through the Service do not infringe any third party's intellectual property, privacy, or other rights, and do not violate any law.
6.Store Credentials & Third-Party Developer Accounts
To build, sign, and publish your apps, you may provide us with sensitive credentials, including Apple App Store Connect API keys, signing certificates and private keys, provisioning profiles, Google Play service account credentials, and push notification keys ("Store Credentials"). We store Store Credentials in encrypted form and use them only to perform the build, signing, distribution, and notification actions you direct.
You are solely responsible for complying with the terms, policies, and developer program requirements of Apple Inc., Google LLC, and any other third-party platform, including their app review guidelines. We are not responsible for any rejection, suspension, removal, or delay of your apps by Apple, Google, or any app marketplace.
7.Push Notifications & In-App Purchases
The Service provides infrastructure to register devices and send push notifications, and to configure in-app purchases and subscriptions within your apps. You are solely responsible for the content of notifications you send, for obtaining all necessary user consents, and for complying with applicable laws (including anti-spam and consumer-protection laws) and platform rules. You are responsible for the accuracy, pricing, fulfillment, and tax treatment of any in-app purchase you offer to your own end users.
8.Reseller & White-Label Program
If you participate as a reseller, you may resell or provide white-labeled access to the Service to your own clients under your own brand and custom domain. As a reseller, you are an independent contractor and not our agent. You are responsible for your own pricing, client billing, client support, marketing claims, and for ensuring your clients comply with these Terms. You agree to indemnify us for claims arising from your resale activities and your clients' use of the Service.
9.Affiliate Program
If you participate in the affiliate program, you may earn commissions on qualifying referred subscriptions in accordance with the commission rates shown in your account. Commissions are subject to verification and may be reduced, withheld, or reversed for refunds, chargebacks, fraud, or violations of these Terms. Payouts are processed through Stripe Connect and require a valid connected account. We may modify commission rates and program terms prospectively at our discretion.
10.Acceptable Use
You agree not to, and not to permit any third party to:
- use the Service to build or distribute unlawful, infringing, deceptive, or harmful applications;
- upload malware, or attempt to gain unauthorized access to the Service or other accounts;
- reverse engineer, decompile, or attempt to extract source code of the Service except as permitted by law;
- resell, sublicense, or provide the Service except through an authorized reseller arrangement;
- circumvent usage limits, build caps, or billing; or
- use the Service in violation of Apple, Google, or other platform policies, or any applicable law.
We may investigate suspected violations and suspend or terminate accounts that violate these Terms.
11.Intellectual Property
The Service, including all software, designs, text, graphics, and trademarks (excluding Customer Content), is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted to you, no rights are transferred. You may not use our name, logo, or trademarks without our prior written consent.
12.Third-Party Services
The Service integrates with third-party services, including GitHub, Apple, Google, Stripe, and notification providers. Your use of those services is governed by their respective terms and policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.
13.Disclaimer of Warranties
Please read this section carefully.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that builds will be accepted by any app store.
14.Limitation of Liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
15.Indemnification
You agree to defend, indemnify, and hold harmless AppNative.io, Virtual Horizons, and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your Customer Content, your use of the Service, your apps, your resale or affiliate activities, or your violation of these Terms or any law.
16.Termination
You may terminate your account at any time. We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees, or use the Service in a manner that creates legal or security risk. Upon termination, your right to use the Service ceases. We may delete your Customer Content and Store Credentials after a reasonable retention period, except where retention is required by law.
17.Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction, except where prohibited by applicable law.
18.Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
